ARTICLE 1
MARKETPLACE NATURE OF PLATFORM
1.1 JO HUKUM operates a technology-enabled marketplace that facilitates connections between Customers and independent service professionals, contractors, technicians, vendors, consultants, and service providers (“Service Partners”).
1.2 Unless specifically stated otherwise in writing, JO HUKUM does not manufacture products, provide engineering certifications, issue statutory approvals, or guarantee the professional qualifications of Service Partners beyond its internal verification procedures.
1.3 The Customer acknowledges that services involving plumbing, electrical work, carpentry, appliance repair, construction, maintenance, cleaning, painting, renovation, pest control, and similar activities inherently involve risks, uncertainties, hidden defects, and technical limitations.
1.4 JO HUKUM shall not be construed as an insurer, guarantor, or warrantor of outcomes beyond the specific warranties expressly provided in writing.
ARTICLE 2
CUSTOMER DECLARATIONS
The Customer represents and warrants that:
a) All information provided is complete, accurate, and truthful;
b) The Customer has lawful authority over the premises;
c) All necessary permissions have been obtained;
d) No hazardous, illegal, unsafe, or undisclosed condition has been concealed;
e) The Customer shall cooperate fully during service execution.
Any loss arising from inaccurate disclosures shall be borne solely by the Customer.
The Customer expressly consents to JO HUKUM collecting, recording, monitoring, storing, using, processing, and retaining information, including communications, service-related interactions, photographs, videos, audio recordings, documents, location data, device information, and any other information provided by or relating to the Customer, to the extent permitted by applicable law, for purposes including quality assurance, service verification, training, customer support, dispute resolution, fraud prevention, safety and security, regulatory compliance, internal audits, business analytics, service improvement, and any other legitimate business purposes.
The Customer further acknowledges and agrees that such information may be shared with JO HUKUM’s affiliates, Service Partners, contractors, service providers, and professional advisors on a need-to-know basis for the aforesaid purposes, subject to applicable law and JO HUKUM’s Privacy Policy.
Scope of Platform Services and Fees
The Company operates solely as a technology-based intermediary platform. The primary and limited purpose of the Platform is to facilitate direct contact, communication, and booking between the Customer and independent technicians.
In consideration for providing this matching and booking facility, the Company charges the Customer a non-refundable service/platform fee.
ARTICLE 3
SITE CONDITIONS
3.1 JO HUKUM reserves the right to suspend operations if any added labour, illegal modifications, undisclosed circumstances, or inappropriate customer behaviour are encountered by the Service Partner.
3.2 Service estimates are based upon visible conditions only.
3.3 JO HUKUM and Service Partners shall not be responsible for latent defects or pre-existing conditions that become apparent during service or after the provision of the Services.
3.4 Discovery of additional defects may result in penalty, additional labour charges, material charges, or revised timelines.
3.5 Work may be suspended immediately where continuation may create safety risks or property damage.
3.6 Decisions regarding continuation, suspension or execution of work shall be at the discretion of the Service Partner, subject to applicable terms and safety requirements.
3.7 The Customer explicitly acknowledges and agrees that any technician assigned or sent to perform a requested task is an independent third-party service provider sourced from an open marketplace. The technician is not an employee, agent, joint venture, or partner of the Platform (“Company”). The Company does not exercise control, supervision, or direction over the technician’s work, methods, or execution of the requested services.
ARTICLE 4
DIGITAL CONSENT
The Customer expressly agrees that the following shall constitute legally valid consent and acceptance, to the extent permitted by applicable law:
a) OTP verification;
b) WhatsApp confirmation;
c) SMS confirmation;
d) Email approval;
e) Digital signature;
f) Invoice acceptance;
g) Advance payment;
h) Online payment;
i) Verbal confirmation recorded by the Company, including phone calls and voice notes.
Such records may be retained and used as evidence in any legal or arbitration proceedings, subject to applicable law.
ARTICLE 5
PRICING AND REVISIONS
5.1 Prices are based upon information available at the time of booking.
5.2 JO HUKUM reserves the right to revise estimates where:
a) Actual conditions differ from disclosed conditions;
b) Additional work is required;
c) Material prices increase;
d) Customer instructions change;
e) Safety requirements increase.
5.3 No service shall continue beyond the approved scope without Customer authorization.
ARTICLE 6
MATERIALS AND THIRD-PARTY PRODUCTS
6.1 JO HUKUM may source products, materials, spare parts, fixtures, fittings, consumables, or equipment from third-party suppliers.
6.2 Manufacturer warranties shall exclusively govern such products.
6.3 JO HUKUM shall not be liable for manufacturing defects, product recalls, supplier insolvency, discontinued products, or third-party warranty denials.
ARTICLE 7
SERVICE COMPLETION
7.1 Upon completion, photographs, videos, work reports, inspection notes, geo-location records, timestamps, invoices, and digital records may be generated.
7.2 Such records may constitute prima facie evidence of service completion, subject to applicable law.
7.3 Customers shall raise visible defect complaints within forty-eight (48) hours.
ARTICLE 8
CUSTOMER CLAIMS PROCEDURE
8.1 Any claim for damage, loss, refund, deficiency, negligence, or warranty issue must be reported through official channels.
8.2 The Customer shall provide, where applicable:
a) Photographs;
b) Videos;
c) Invoices;
d) Supporting evidence;
e) Access for inspection.
8.3 JO HUKUM reserves the right to reject claims that:
a) Lack evidentiary value;
b) Are inevitable and beyond the scope of service;
c) Involve third-party interference;
d) Are reported after unreasonable delay;
e) Involve customer misuse.
8.4 No repair, modification, or replacement shall be undertaken by third parties before inspection by JO HUKUM.
Failure to comply may invalidate the claim.

ARTICLE 9
PROPERTY DAMAGE CLAIMS
9.1 The Company must be notified within twenty-four (24) hours of discovery.
9.2 JO HUKUM shall have the right to investigate the alleged damage before liability is determined.
9.3 The Company may appoint independent experts, surveyors, engineers, or assessors.
9.4 Compensation, if payable, shall be limited to the reasonable repair cost directly attributable to the actions of the Service Partner.
9.5 The Company shall not be liable for:
a) Sentimental value;
b) Emotional distress;
c) Loss of business;
d) Consequential damages;
e) Speculative losses;
f) Depreciation.
ARTICLE 10
FRAUDULENT CLAIMS
If JO HUKUM reasonably determines that a Customer has:
a) Fabricated evidence;
b) Submitted false claims;
c) Manipulated photographs or recordings to support false claims;
d) Concealed material facts;
e) Attempted extortion or coercion towards the Company or its stakeholders;
the Company may:
i) Reject the claim;
ii) Suspend services;
iii) Permanently blacklist the Customer;
iv) Take any legal action as deemed necessary.
ARTICLE 11
CUSTOMER CONDUCT
Customers shall not:
a) Abuse personnel;
b) Threaten Service Partners;
c) Engage in harassment;
d) Make defamatory statements;
e) Interfere with service execution;
f) Demand unlawful work;
g) Engage in any other unlawful or inappropriate actions.
The Company may immediately terminate service without refund in such circumstances and may initiate legal proceedings where deemed necessary.
Total Exclusion of Liability for Misconduct
To the maximum extent permitted by applicable law, neither the Company nor its directors, officers, employees, or affiliates shall be held liable, responsible, or accountable for any actions, omissions, errors, or misconduct of the technician.
This includes, but is not limited to, any verbal abuse, physical misbehaviour, harassment, theft, property damage, negligence, or criminal acts committed by the technician against the Customer or any third party.
Customer and Technician Interactions
All communications, interactions, agreements, and engagements—whether verbal, physical, written, or otherwise—between the technician, the Customer, and any other individuals present at the Customer’s premises are entirely at the parties’ own risk.
The Company does not monitor, govern, or guarantee the safety or appropriateness of private interactions and disclaims all liability arising out of or related to such encounters.
ARTICLE 12
NON-SOLICITATION
Customers shall not directly hire, engage, recruit, contract with, or solicit any Service Partner introduced through JO HUKUM for three (3) months following the most recent booking.
Where such engagement occurs, the Customer shall be liable to pay liquidated damages equal to the greater of:
a) INR 50,000; or
b) Six months’ service revenue reasonably estimated by JO HUKUM,
whichever is higher, subject to applicable law.
ARTICLE 13
PLATFORM RIGHTS
JO HUKUM reserves the right to:
a) Refuse service;
b) Cancel bookings;
c) Suspend accounts;
d) Blacklist Customers;
e) Modify pricing;
f) Verify Customer identity;
g) Record communications for quality, legal, and security purposes in compliance with applicable laws, including the Digital Personal Data Protection framework and applicable information technology laws.
ARTICLE 14
LIMITATION OF LIABILITY
To the maximum extent permitted by law:
a) JO HUKUM’s aggregate liability shall not exceed the amount paid for the specific service;
b) JO HUKUM shall not be liable for indirect, incidental, special, punitive, exemplary, or consequential losses or any other enforceable losses;
c) Loss of profits, revenue, goodwill, opportunity, business interruption, or reputation shall be excluded.
ARTICLE 15
INDEMNITY
The Customer shall indemnify and hold harmless JO HUKUM, its directors, officers, employees, affiliates, shareholders, Service Partners, agents, and representatives against all claims, liabilities, damages, penalties, legal costs, and expenses arising from:
a) Breach of this Agreement;
b) Customer negligence;
c) Inaccurate information provided by the Customer;
d) Unsafe premises;
e) Violation of law;
f) Any situation beyond the control of the Service Provider.
ARTICLE 16
DISPUTE RESOLUTION AND ARBITRATION
Any dispute shall first be referred to the Company’s Grievance Officer.
If unresolved within thirty (30) days, the dispute shall be referred to arbitration under the Arbitration and Conciliation Act, 1996.
The arbitration shall:
a) Have an arbitrator appointed by mutual consent;
b) Have its seat and venue at Jodhpur, Rajasthan;
c) Be conducted in English.
ARTICLE 17
GOVERNING LAW
This Agreement shall be governed exclusively by the laws of India.
Subject to consumer rights available under applicable law, courts located in Jodhpur, Rajasthan, shall have exclusive jurisdiction.
ARTICLE 18
SURVIVAL
The provisions relating to indemnity, limitation of liability, evidence, confidentiality, dispute resolution, intellectual property, and non-solicitation shall survive termination.
CUSTOMER ACKNOWLEDGEMENT
BY PLACING A BOOKING, MAKING PAYMENT, ACCEPTING A QUOTATION, OR RECEIVING SERVICES, THE CUSTOMER ACKNOWLEDGES THAT HE/SHE HAS READ, UNDERSTOOD, AND AGREED TO BE BOUND BY THESE TERMS AND CONDITIONS.
